     Job Summary

    Reporting to a Med/PIP Claims Supervisor, this advanced level PIP/No-Fault Adjuster position is a litigation specialist responsible for investigating, negotiating and resolving PIP and Medical Payments pre-suit demands, arbitrations and/or lawsuits. This includes developing litigation strategy, coordinating with defense attorneys and performing complex decision making in accordance with state statutes and company guidelines. 


    Essential Job Responsibilities

    • Analyzes new litigation assignments within company and state timeframes and standards to determine recommended handling. Clearly documents claim file with analytical findings on issues in dispute, strength of defense and uses discretion and independent decision making in development of litigation strategy. Obtains necessary documentation and timely and accurately reserves file and maintains adequate and accurate reserves. Elevates recommendations outside authority to the MedPIP Supervisor as appropriate.
    • Engages in negotiations with opposing counsel and resolves settlements within prescribed authority. Ensures timely and accurate responses to opposing counsel, injured parties and/or medical providers and obtains required stipulations, dismissals and/or releases as required.
    • Recommends and appoints defense counsel as appropriate. Coordinates meetings with defense counsel and facilitates defense strategy discussion. Makes defense recommendations.
    • Responsible for calculation of appropriate settlement payments inclusive of determining applicable indemnity costs, fees and interest. Reviews litigation related expenses to determine proper payment. Issues payments timely and accurately.
    • Creates/conducts training to educate adjusters on best practices in support of continuous improvement initiatives. Identifies and tracks handling opportunities in order to advise leadership of trends.
    • Serves as a mentor and technical lead for the MedPIP Department. Stays on top of relevant statutory changes and new case law which could impact the business and makes recommendations to leadership.
    • Performs other duties as assigned.


    Experience/Skills Requirements

    • A minimum of five years of PIP/No-Fault claims adjusting experience including litigation handling and advanced understanding of personal injury protection laws, regulations and statues is required.
    • Strong knowledge of CPT billing practices & procedures.
    • Ability to analyze information with strong attention to detail, think independently and draw thoughtful conclusions.
    • Ability to collect, compile and organize facts, figures and/or other information in accordance with state statues and company guidelines for Medical payments and PIP claims adjusting is needed.
    • Ability to utilize medical and legal references to research information is needed.
    • Ability to perform basic math calculations (addition, subtraction, multiplication, and division).
    • Ability to provide oral and written communication is required.
    • Experience with Microsoft Office required.

     Education Requirements


    • High school diploma or equivalent required.  Bachelor’s degree strongly preferred.
    • Florida All Lines Adjuster License - 620 required.
